It has now been revealed that retail giant, Wal-Mart, has agreed to pay $10 million to the family of the comedian killed in a crash that also severely injured actor/comedian Tracy Morgan. Wal-Mart settled out of court with James McNair‘s family in late January, after one of its trucks slammed into a luxury van carrying McNair, Morgan and other comedians after a show on the New Jersey Turnpike last June. McNair, 62, also known as “Uncle Jimmy Mack” was a close friend of Morgan, a stand-up comic and a comedic writer. He left behind two children.

The driver of Wal-Mart’s truck has been charged with “death by automobile” and four other vehicle assault charges following the deadly crash. The former cast member of Saturday Night Live and 30 Rock star is still recovering from injuries he sustained in the life-altering crash. He continues to undergo daily speech, cognitive and physical therapy and has been rarely seen in public.
